ENETPULSE TERMS AND CONDITIONS OF USE

PLEASE READ THESE TERMS AND CONDITIONS OF USE CAREFULLY. BY ACCESSING OR USING THIS WEBSITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS DESCRIBED HEREIN AND BY ALL TERMS, POLICIES AND GUIDELINES INCORPORATED BY REFERENCE WHETHER YOU CHOOSE TO READ THEM OR NOT. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, DO NOT USE THIS WEBSITE.
This site is used to pay an invoice to Enetpulse ApS. The following terms and conditions only apply to invoice payment. For the terms and conditions of your order, please refer to our website and any former communication or contact us at support@enetpulse.com.
We will not disclose information about customers or users to a third party, unless it is necessary to implement a transaction. We will not sell or disclose your name, address, email address, credit card information or personal data to any third party without your prior permission.
From the start of the selected term/contract, Enetpulse will provide content to the Subscriber via Enetpulse server(s) in Extensible Markup Language (XML) or JavaScript Object Notation (JSON) format. If the Subscriber needs the Enetpulse content for more servers and/or websites an additional Agreement will have to be made.
Your credit card will be debited within about a week from the date of your purchase.
Should you want to cancel your purchase please contact sales@enetpulse.com. This must be done no later than two weeks after the date of the original order providing you have not used the Sports data. In that case your purchase is binding. Any claims of refunds will hereafter be void. Enetpulse considers the data "used" when a succesful delivery of sports data to the Subscriber has been made from our servers. If the return conditions are met, the full amount you paid will be refunded.
Any dispute relating in any way to your use of the Site or the Enetpulse Sports Content shall be subject to Danish law.
In the event that Danish law is not legally binding, it shall instead be submitted to confidential arbitration except that, to the extent you have in any manner violated or threatened to violate Enetpulse intellectual property rights, Enetpulse may seek injunctive or other appropriate relief in court, and you consent to exclusive jurisdiction and venue in such courts. Arbitration under this provision shall be conducted by a single arbitrator. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to the Site Terms, whether through class arbitration proceedings or otherwise.
Not withstanding any of these Site Terms, Enetpulse reserves the right, without notice and in its sole discretion, to terminate your account and/or to block your use of the Site and any transmission of sports data.
Any waiver of any provision of the Site Terms will be effective only if in writing and signed by Enetpulse. If any clause in these Site Terms is found to be unenforceable, wherever possible this will not affect any other clause and each will remain in full force and effect. Any rights not expressly granted herein are reserved.
Enetpulse reserves the right to change any of the terms and conditions contained in the Site Terms or any policy or guideline of the Site, at any time and in its sole discretion. When we make changes, we will revise the "last updated" date at the top of the Site Terms. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of changes will constitute your acceptance of such changes. We encourage you to review the Site Terms whenever you visit one of our websites.
THIS SITE AND THE ENETPULSE CONTENT ARE PROVIDED "AS IS" AND ENETPULSE AND ITS DIRECTORS, EMPLOYEES, CONTENT PROVIDERS, AGENTS AND AFFILIATES EXCLUDE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY WARRANTY, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. ENETPULSE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THIS SITE OR THE ENETPULSE CONTENT, OR THE UNAVAILABILITY OF THE SAME, INCLUDING, BUT NOT LIMITED TO LOST PROFITS, AND DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. THE FUNCTIONS EMBODIED ON OR IN THE MATERIALS OF THIS SITE ARE NOT WARRANTED TO BE UNINTERRUPTED OR WITHOUT ERROR. YOU, NOT ENETPULSE, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION DUE TO YOUR USE OF THIS SITE OR THE ENETPULSE CONTENT. WE MAKE NO WARRANTY THAT THE SITE OR THE ENETPULSE CONTENT IS FREE FROM INFECTION BY VIRUSES OR ANYTHING ELSE THAT HAS CONTAMINATING OR DESTRUCTIVE PROPERTIES.
Enetpulse uses great efforts to ensure the accuracy, correctness and reliability of the Enetpulse Content, but we make no representations or warranties as to the Enetpulse Content's accuracy, correctness or reliability.
IN NO EVENT SHALL ENETPULSE, ITS DIRECTORS, MEMBERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF THE SITE, THE SERVICES, THE ENETPULSE CONTENT OR THE MATERIALS CONTAINED IN OR ACCESSED THROUGH THE SITE, INCLUDING WITHOUT LIMITATION ANY DAMAGES CAUSED BY OR RESULTING FROM RELIANCE BY USER ON ANY INFORMATION OBTAINED FROM ENETPULSE, OR THAT RESULT FROM MISTAKES, OMISSIONS, INTERRUPTIONS, DELETION OF FILES OR EMAIL, ERRORS, DEFECTS, VIRUSES, DELAYS IN OPERATION OR TRANSMISSION OR ANY FAILURE OF PERFORMANCE, WHETHER OR NOT RESULTING FROM NATURAL DISASTERS, COMMUNICATIONS FAILURE, THEFT, DESTRUCTION OR UNAUTHORIZED ACCESS TO ENETPULSE RECORDS, PROGRAMS OR SERVICES.
